The Story of Martha: When Good Intentions Come Too Late
Martha was a successful business owner who lived and worked in South Orange County. She was thoughtful, responsible, and deeply cared about her family. Like many professionals, she knew estate planning was important. She just did not realize how quickly time could run out.
In June of last year, Martha met with Ocean Estate Law to create her estate plan. We spent time learning about her goals, her business, and how she wanted her assets handled. Her documents were carefully prepared and ready for review and signing.
Life, however, got busy.
We followed up with Martha over the following weeks and months, as we routinely do with our clients. Like many people, she believed she had more time.
In November, we received a call from her family.
Martha had been hospitalized and was not doing well. Her family wanted to know whether her new estate planning documents would still be valid if she did not recover.
Legal Capacity and Why Timing Matters in Estate Planning
This is the part of the story we wish had a different ending.
By the time Martha was hospitalized, she no longer had the legal capacity required to sign her estate planning documents. Under California law, a person must be able to understand the nature and effect of the documents they are signing. Without that capacity, even perfectly drafted estate planning documents cannot be executed.
Despite her clear intentions, it was too late.
Without signed and finalized documents, Martha’s estate would be handled under California law, not her personal wishes.
Why You Cannot Wait Until a Crisis to Plan
Many families assume estate planning can be completed quickly once there is an emergency. Unfortunately, that is rarely the case.
From start to finish, a properly prepared estate plan typically takes four to six weeks, sometimes faster if there is a clear and urgent need. This process includes gathering information, legal drafting, review, and proper execution.
Once illness, injury, or cognitive decline occurs, estate planning may no longer be possible.
